Hard to tell anything from the picture you posted. Take the fork to any good local bike shop and ask for them to evaluate it. Your concern about how long the frame and fork have been in your posession and what the place you purchase from might think is totally invalid at this point, as your primary concern should be whether the fork is or isn't safe to ride. Once you establish the answer to this primary concern then you could move on to lesser matters such as who might be responsible to replace the fork if it is not safe to ride.

Very true, thanks J. I'll be taking the fork to a shop in the near future and trying to figure out what to do from there if the need arises. I was getting a bit emotional in all honesty because I've put so many miles on the bike, and at any moment may have crashed at speed, due to the steerer. A strange feeling.
Hopefully this is nothing to worry about, but I suppose I'll find out soon enough.
