I wasn't 100% clear in my original post so I've edited it. The bike was damaged and that has been repaired, but there doesn't appear to be any damage to the frame. So from what you've said, I have to hope that if the frame is going to fail due to a crack that can't be seen, then it has to happen before I settle with the other party? In that case it's in my interests that the case drags on for as long as possible.

There's a big difference between a bike falling over and crashing and a bike being hit by a moving vehicle and crashing to the ground with the rider's 115kg weight on top of it.
