The driver DID see you but decided to make a risky turn that put YOU at danger. Make no doubt about it. He saw you and thought he pull off that turn in time but it could have killed you.
Your injuries including pain and suffering are worth much more than you think. I don't now what the court system is where you live but in the US, I was a awarded $1,100 USD by the insurance company for a single scratch when I was doored in 1987. I took his insurance company to small claims court asking for $500 USD but they settled it for more since it was cheaper than having to be represented by an attorney.
The injuries you incurred are worth far more than mine. You need to report this insurance company right away.
Go to an emergency room and get a police report ASAP!!!
Once his insurance rate goes up, he'll be a more careful driver. I'm serious. My nephew was involved in several motor accidents in a period of several months. Once his insurance sky-rocketed to $4,500 USD a year, he began driving defensively and the accidents stopped.
