I suspect that Walmart would give the customer a new bike or a refund with no questions asked, especially when the product has been declared defective by the manufacture.

Again, the point is that buying from an LBS provides no assurance of a perfectly assembled.designed or even appropriate bike, nor is it any guarantee of eternal and/or wonderful service support.
