Hmm...I'm not sure about that one. Fair use might actually cover the copyright end of this seller's actions, unless the offending party was selling the images or was somehow causing loss (financial, emotional, otherwise) on the part of the photographer. Misrepresenting an item in an eBay auction is a no-no, and shouldn't be allowed. But at the same time I don't think you'd get very far suing someone for a portion of the profits they received when they used your photos to sell a single product in an online auction.
