The problem is, as of now, it's not a manufacturing defect. The frame is 12 years old. I think it was manufactured just fine. This is a wear and tear issue and won't be covered as a warranty.
The whole thing about running over the bike with a car to then claim a crash replacement was what I was referring to as fraud (because it is).
Hopefully the OP can work something out with C'dale and get back on the road.
