So what is that going to be a penalty over? Intention to cheat? If they buy the 'tainted beef' defense from time to time, then they'd probably buy the 'oh that wasn't my bike!' defense too.
The burden of proof is different in this case. As I understand it, under UCI regulations it is the responsibility of the rider to have a compliant bike, if they do not, they are responsible for it.
