This probably speaks more to the DC justice system than to actual fault of the parties involved. Generally when you see a disparity like this it means that some sort of bias is involved. You'd think that the government of DC would know this.
This stupidity is why a lot of motorists' in the DC-MD-VA area, in bike-car collisions, are rarely held accountable, when it was definitely the driver's fault.
A contributory negligence law is another perfect excuse for this recent bike fatality:
