It's not that uncommon in a general sort of way, but this specific treatment, with the seat stays butted against the tube just below the lug, rather than against the lug or the seat post pinch bolt, etc, is pretty unusual.
Agreed. Perhaps there is not a hard definition, but if the binder bolt isn't integrated into the seat stays I don't refer to it as "fastback".
