The punishment suggested earlier by Tim was pretty serious, which was why I suggested that the lack of clear intent made it unreasonable to expect it to be imposed. And if we do expect it to be imposed on others, we should expect similar punishment to be imposed on us, to the same degree.
I might have also said that if the OP was being assaulted to begin with, by putting himself back in front of the truck he as much as stepped in front of a person waving a loaded gun. That's not assault, that's ones own recklessness.
If you have to do some crazy mental gymnastics in an effort to prove a point, you probably don't have a valid point.
