No.....the person who has the accident, has a family sue for their loss. They will try to sue the helmet manufacturer, the bike manufacturer, etc.....generally a blanket lawsuit at anyone and anything to get a settlement of some kind.

They won't be successful, because the helmet was glued and no longer in spec. An easy out for the helmet maker.
