The industry won't support using moped legislation. We already have model eBike legislation being adopted. That train is out of the station and gaining momentum. There's no going back.
The definition of moped would easily have accommodated eBikes. The definition of moped includes pedal bikes that are power-assisted. The original mopeds were pedal bikes with gasoline motors providing power assist, and an eBike is the same thing with an electric motor.
The funny part is that mopeds had pedals to circumvent existing laws around motorcycle licensing. eBikes have pedals to essentially do the same sort of thing, to make them to be seen as acceptable where they otherwise would not belong.
