It's still the law to drive a motor vehicle in a manner suitable to the conditions. Whether that's due to weather, or crud in the road, or slower-moving vehicles, animals or people not in cars, etc.
Shoving aside someone with a car simply because he's there and slower moving would go over really well in a court of law, I suspect. Rightly so.
