While laws can be, laws rarely are. You could end drunk driving overnight if you really wanted to by requiring all vehicles to have alcohol sensing devices to start, but people will not agree to restrictions that affect them in the slightest bit. It is far easier to pretend to care about the issue by appearing "tough" on those who are actually caught, while ignoring the fact that drunk driving, distracted driving, etc is something that is committed by a large portion of the population. It is far easier to just punish than actually look at the root causes of the problem and fix it, especially when dealing with those who simply don't think about the consequences of something prevalent that they will likely go their life without ever getting in trouble over.
