Stupid because of the rules (they are overreaching) but I believe that even if you are not in California, if you sell it to someone there, that is what matters, as far as I can tell. I may be wrong, though. I think it's the same as when motorcycle engines are "49 state legal" or "50 state legal". The former is not allowed to be shipped to California to be used there.
