Q: If its legal & safe for a vehicle to pass then there is a broken line and the vehicle should pass using the other lane (US and 2-lane road) correct?

Given yes, then why not take the lane to help ensure the car passes legally and safely?

For sure safety is always cyclists priority so other options can help prevent accidents.
