See the screen capture from the link you provided to try to prove your point (which it didn’t).

Class 3 e-bikes can only provide assist while the rider is pedaling, not via throttle. This is the same in all 50 states.

Velotirc will not like the outcome when they end up in court for allowing a rider to use throttle above 20 mph. Lawyers would have a field day with this.
