Let's say the next time one of you blows a stop sign, you're pulled over by a cop who then proceeds to beat you with his nightstick until you pay the fine on the spot. Is that forced payment of the fine just a "technicality" that should be overlooked because you were actually guilty of running the stop sign?
Or suppose you're brought to trial, and at trial, your Constitutional rights are violated. Maybe the cop beat a confession out of you (and maybe you only "confessed" to stop the beating) and that was used to convict you; maybe you had a right to have an attorney represent you and were denied that right; maybe you had a right to have a jury of your peers hear the evidence against you and that was denied you. Whatever right was violated, would you be willing to surrender it as a "technicality" or a "loophole"? Or would you ask for the fair trial the Constitution guarantees you?
Thank you. Having to grit one's teeth sometimes when a really rotten person doesn't get what they deserve is part of the price we pay for not living in a fascist regime. I'd rather have damaged teeth than damaged liberty, personally.
