There could have just as easy been any number of other obsticles there (pedestrians, pets, a pot hole, a case of empty beer bottles, a wayward shopping card). Yes they should have had lights or at least reflectors, but you still need to be prepared for unexpected obstacles. There is always a chance of obstacles that don't have lights.
