Could charges be laid against the driver? Certainly. Here's what would likely happen, the cyclist would be charged with reckless driving (sure the car shouldn't be there, but it was parked, and you didn't see it?), most likely you'd be liable for the damage to the car, and the cop would just shake his finger at the driver for being in the bike lane.
