Okay, I am not sure why you are blaming Ebay. They got a complaint saying the seller doesn't own the bike. They contact the seller and he says "yes I do". What real proof do we have that he doesn't, other than some pictures of the bike on another website?
Because he has it against his account that there have been enough similar cases before (some of which utilizing photos from other sites then Bikeworks.NYC) + the testimony of the seller of the Bob Jackson.
