The abusive driver program was set up as a series of "fees" because the Virginia Constitution says any "fines" have to be put immediately into an educational coffer for retiring teachers and school construction.
Fees can't be reliably collected from out-of-state drivers because the state can't withhold driver's licenses from non-Virginians. Cornish doesn't even have a driver's license, so it's unclear how the Department of Motor Vehicles could force him to pay the stiff penalties.
The abuser fees program was the brainchild of Del. Dave Albo, R-Fairfax, who works as a traffic attorney outside the legislature.
