Finally, someone charged with a felony just for their driving behavior. Usually felony charges are only used when the driver is DUI,so the felony is not based primarily on the driving behavior, but on the fact that the driver was drinking while driving.

Nope not the case here... again it had to be some other mitigating factor... "over the limit... "
