Take it to court if you get a ticket. If the light does not register you it is malfunctioning.

You are expected to obey the rules of the road like any other vehicle. If you are in your car and you come upon a red light that does not turn, you wait a reasonable amount of time, then give up on waiting and treat it like a stop sign. Otherwise you are impeding traffic.
