i suppose if you have a bad accident and the cops aren't doing anything for you then you could go after them. i was just thinking of a driver trying to involve insurance in an accident even if it was on the road simply because it was in "traffic".
In my experience it is extremely hard to sue for damages if there isn't an accident report from the cops. Any time you have an accident, and there is any chance of bike damage or injury, make sure to file a report with the cops. If it appears more serious or you
are injured, ask for ambulance/paramedics to be called to the scene...this brings cops as well who then
have to file a report.
