Just because it rubs doens't mean it's out of true. No tire is going to sit perfectly, perfect on a rim. Especially cheap tires. If you can flex your wheel while out of the saddle, that means your wheels is dangerously under-tensioned. I suggest you get a tensionmeter and bring it up to spec before you hurt yourself or break a spoke.
