This is misleading. The BAC level, for example .08%, is a "per se" level. That is, you can be arrested and convicted just for being at that level or above while driving.

However, you can get a DUII at any BAC if the police can prove you were intoxicated to the point it influenced your driving. It's not about the number; it's about intoxication.
