Wouldn't lots of cars frequently drive in the "door zone" too? If you open your door on them I'm pretty sure it's your fault. Parallel parked cars driver doors are always gonna be pretty close to the traffic lane, at least around here.
I also see your point about the jury though, hopefully it won't get that far.
The officer said the same thing about cars driving through the door zone and how its a motor vehicle accident so it should be treated just as if he opened the door on a car. Where else do I ride?...the middle of the road?! I just emailed a lawyer who is on a team here, so maybe he can help. No pics, the bike is getting an estimate done, but the frame is trashed and the wheels. And there is no gory wounds...thank god.
