This will be the 5th part ( 2 cranks and 3 wheels) that Trek has replaced for me with no cost, no question, even when they know I ride 10,000+ miles a year. I'm not experiencing any pain anymore and I was still able to maintain my riding (very carefully and slowly). I may ask the LBS to throw in something else when I go pick up my bike like a new bike bottle and cage or something..
P.S. I think one of the reasons for the slow 5 day response is so the Lbs and possibly trek run things by their legal department.
Thing is neither Trek nor the LBS is ultimately responsible for the failure. This would strictly be the manufacturer of the cranks. I'd take it up with them directly.
BTW - someone else on here turned a kind of similar issue into 2 brand new top of the line frames...like TdF ridden....
I know you say your a lover not a fighter, but not fighting means that you lose....because someone else will just fight and take whatever it is you want...while you sit and watch.
