The standard does many things, among which: it makes sure nobody buys a helmet that underperforms the minimum level, and it provides some protection to manufacturers from lawsuits if their designs are certified to those minimum level tests.
I can see the engineers at a helmet company sincerely trying to design a "safer" helmet. I can't see the legal department signing off on an advertisment that makes that claim.
