I'd check the laws in his state first. For example, in Vermont, pedestrians can't just run out in front of traffic, especially if they're not in a crosswalk. Even if they are in a crosswalk, they need to make sure traffic can (and will) stop safely for them. This is contrary to popular belief but plainly spelled out in the motor vehicle statutes...

§ 1051. Pedestrians' right of way in crosswalks
(b) No pedestrian may suddenly leave a curb or other place of safety and walk or run into the path of a vehicle which is so close that it is impossible for a driver to yield.


§ 1052. Crossing except at crosswalks
(a) Every pedestrian crossing a roadway at any point other than within a marked crosswalk shall yield the right-of-way to all vehicles upon the roadway.
