I got sick of it, told my LBS to give me the bike back when it worked right. They were very cool about it since I didn't buy the bike there. But I buy plenty of stuff from them (just got a new Cervelo from them in February). They contacted Avid, the bike should be back on the trail by late March.
I think I know what the issue was. There was a batch of bb5's and bb7's that had faulty assemblies inside the caliper. And would cause the rubbing and it would eventually stop due to the assembly breaking, making the brake useless.
