And a writ of habeas corpus demands that the evidence of the crime be introduced for examination by the defense. A photograph of a store and the words: "Defendant wanted to steal something from here" wouldn't establish that any crime had been committed. "This person COULD have..." don't cut it. Any shop that did that would be wide-open to a lawsuit. IF the person were an adult. Juvenile legal statues are more variable state-to-state.
