When I pass pedestrians, depending on the circumstances, I'll let them know I'm passing-on-the-left. There's no doubt in my mind that your wife is at least 50% or more responsible if she passed a pedestrian without alerting them that resulted in bodily injury accident. It is just being careful and using 'common sense'. If you or your wife hit me with a bike, and I was walking, I'd probably sue you too.
