Looking at the second picture, as long as it lines up under the seatstays as well as it does the chainstays I'd probably figure it was fine; I think it only looks that bad because of how closely its built to begin with.
I just took that picture and drew perpendicular lines and lined the horizontal one up with the inscribed numbers in the bottom bracket which presumably is parallel to the bottom bracket axel and normal to the longitudinal axis of the bike. When I did that, the vertical line went right through the center of the tire. It looks like everything's square to me.
