Drive throughs are private property and most restaurants have the right to serve or not serve anyone they want (except for explicit discimination on the basis of gender, race, religion, or military status).

I have heard of bank drive throughs refusing to serve people in wheel chairs. That is legal, but probably not very intelligent from the publicity point of view.
