The Texas law is pretty-much the standard FRAP law. The interesting thing about the FRAP law is that it allows the cyclist a fairly-wide lattitude in making the decision to "take the lane" or not. The "Conditions of the roadway ... make it unsafe to ride next to the right curb or edge of the roadway" clause lists some examples but it doesn't list all of the reasons. This clause makes it clear that the cyclist has to have some reason not to ride to the right and that reason has to be related to safety. "Just because they want to" is not such a reason.
The thing about TX law is, though, that by definition, everything to the outside of the fogline is not considered to be roadway. For this reason, the shoulder on the OPs road is not a road.
