Can you press charges??? WTF! If you approach an intersection at high speed down a hill you are taking your chances! If you think you will be seen by every car you are wrong. Just because the law says you share the road doesn't mean a ton of metal will not still kill you. Don't be so arrogant.
So if you are going to share the road, do so knowing that you are at a great disadvantage and ride accordingly. Sorry if that means you have to lose all of your momentum down a hill at an intersection. Yeah, really sorry! You are not a car, you are not visible, you are not expected, and... you don't stand a chance. So who the heck are you going to sue?
If you want to have all of the rights as cars... here is the really painful truth... YOU ARE GOING TO HAVE TO OBEY THE SAME RULES! Hmmm... don't want to stop at every stop sign? Don't want to stop at red lights? Don't want to use hand signals when turning? Want mandatory insurance to ride on the street? Want to ride home drunk? Here's one: want to get a speeding ticket for going 25 in a 20 mph zone???
I didn't think so.
You are not all professional bike messengers or racers. Don't ride like one.
Lawsuit? Grow up! Get yourself some health insurance and stop looking for a big payout when finally your number comes up.
I know several people who have been badly injured in bike vs. car collisions. It was arguably the cyclists behavior which was at fault, even though LEGALLY it was a toss up. Good luck protecting your skull with the law. If you go rock climbing and you fall... are you going to sue gravity?
I know I am going to get a lot of **** for this, but we are all running with the bulls when we take to the street. Until we get independent bike lanes on every road, we had all better know our place in the pack.
I am again, sorry the OP is injured, and wish him a speedy recovery.
