^^ In large measure I think it depends on who's passing whom. If cyclist comes from behind truck in the vacinty of an intersection, and trys to dart ahead as the truck turns, that's an extremely dangerous move for the cyclist to make. And this is what the witness appears to describe.
If truck passes cyclist just before the intersection, and hooks cyclist, then there's a much better argument to put fault on the truck.
Regardless of fault, however, as a matter of self preservation, you have to understand that any vehicle may turn right in front of you at an intersection, and its all the more likely with a large truck and blind spots.
Thus we ascyclists have to be watching for right turn hooks.
