Some cops do act..

A 24-year-old motorist from Staten Island was arrested on Sept. 11 after she sparked a chain of events that led to the horrific death of a bicyclist near the corner of Atlantic and Washington avenues, but then refused to admit her role in the tragedy.

Good for the cops, catching her before she got away entirely. But if the only charge she ends up fcing is driving on a suspnded license, then the D.A. needs to find a new line of work.

Good for these cops for making some effort. While the cause of this tragic death was the illegal actions of the driver in opening her door, this horrific outcome could have been avoided if the cyclist had not ridden in the door zone. It is really difficult to get people, particularly new riders, to understand that they have a right to as much of the lane as they need to avoid hazards (like doors).

I love the always-classy reporting from the NY Post:

Francis attempted to drive away, claiming that she had nothing to do with the accident and was running late to a baby shower, but responding officers dragged her back to the scene. She was later charged with driving on a suspended license, police said.

There's nothing illegal about opening the door of a parked car. Something could definitely come of that in a civil suit, but no law was broken at that time. Now when she left the scene of the accident on the other hand, that's a different story and I would have expected to see more than just a suspended license charge stemming from that.

Depends on the law... most places where I've looked it up, it is illegal to open a car door into the path of approaching traffic.

Right. But in Washington (State, not DC) it is illegal to open a door in a parked car, when you haven't made sure that it's safe to.

No person shall open the door of a motor vehicle on the side available to moving traffic unless and until it is reasonably safe to do so, and can be done without interfering with the movement of other traffic, nor shall any person leave a door open on the side of a vehicle available to moving traffic for a period of time longer than necessary to load or unload passengers.
It's illegal in NY as well if the accident happened on the side with traffic.

Actually, yes, there is. You're legally required to check to make sure that you're not opening the car into the path of any traffic, including bicycles and pedestrians, whether you're getting into or out of the car.

Nice, two year ago a man cycling downtown Toronto was DOORED, knocked into traffic and then run over by a bus. This woman should face serious charges of negligence.

I really wish it was easier to convince newbies it really is safer to ride further into traffic and away from the door zone. So many people get killed or injured needlessly because of the illusion of safety...

Did I read the same story? The article indicates contact between the car/driver/door and the cyclist:
Krystal Francis was getting into her Dodge Stratus parked on the east bound side of Atlantic Avenue at 8:38 pm when she opened her car door, clipping 23-year-old Flatbush resident Jasmine Heron as she passed on her bike — knocking the woman into the path of a B45 bus making its turn onto Washington Avenue.

The key quote was "...She was later charged with driving on a suspended license, police said."

There is no indication from the article that she was charged with anything else...

There is a lot of pressure for a newbie to ride right - right in a door zone. Particularly in an urban setting like NYC.
