Most racks simply need a spacer for the caliper side. One rack I have I bent the last part of the leg to not need the spacer. No big deal either way. It is however more critical to keep the bolt tight, as anything loose will result in a leverage instead of a shear load(normal would be shear).
I have run the setup for several years under messenger level loads, so it should work fine.

Are you trying to put a bike with disc brakes on a roof mounted car rack? If so, take a look at the Yakima Viper. On sale through Sunday at your local REI.

I got my LBS to order one of these (Axiom Journey Rack). It has a extra joint and rod to fit around the caliper. I think it cost about $35.

If you use a Blackburn style rack with two struts and a spacer it will keep the pannier off enough to not worry.
