Yes, get a replacement. What you are describing is a bad accident looking for a place to happen and it will probably find one soon. A fork in that condition is a real hazard.

One of the keys to using the front brake is to shift your weight back. This counteracts the forward shift from braking. It helps if you lift your butt off the saddle a few mm, so that you're balanced on your legs.
