I did submit the pic and completely forgot. It had to be early last year. *insert appropriate smiley* Indeed there is a box to check granting permission for Brooks to use the image. I guess we see why the US is notorious for being an overly-litigious society.

I'm glad the email I sent was free of accusations. I essentially said "Thanks for posting a picture of my bike. Who you like to see a picture of this tandem outfitted with a fine pair of heavy duty sprung saddles?" hint hint

A $ 80 dollar small claims court filing fee ought to net you up to $1000 in compensation. Or a threat of such a saddle for every bike you own.

The right way to follow up!

I still think they could have put a little "This beautiful bike is proudly owned by HelluvaStella" at the bottom of the photo . Just so the rest of us could brag about the bike being owned by a BF member!

Yes, but the owner of the bike can restrict the use of the photograph unless the photographer got a property release!

Oh for Pete...

Please provide another link to it. Brooks is not allowing me to copy it to my hard drive...

Yup, it says

"I hereby authorise Brooks to communicate or publish my story and pictures in any way they see fit. *

I agree to let Brooks England Ltd store my data in their database for mailings in respect of privacy laws applicable in the UK and Italy - where the website is hosted.
Your details will not be shared with any party, other than Brooks England Ltd, and its shareholder Selle Royal S.p.A.

They say the memory is the first to go.

Just be happy Brooks posted your picture. Few of us have that claim to fame. I see the picture is also in the Photo Contest Hall of Fame with your city, state and country.

Don't mean to highjack this thread but I got to wondering. On the front of the current Brooks Cycle Bags catalog is a picture of a man riding his bike. The photo only shows the back of the bike anyone know what bike is he riding?

Great to know that our home page generates a thread in bikeforums.
I've replied to the owner of the bike and picture that he can get a couple of saddles with 50% discount from our online shop. Fair enough?
Thanks for the suggestions, except for that of sueing our company.
I'll make sure that when we restyle our website we give a proper prize to those who win the "homepage of the month"!

I was just about to post about Andrea's email and generous offer, but he beat me to it! Well, there you have it: Brooks has a great thing going. They run a great website and they are encouraging submissions of bike pictures and stories. And now, where's my credit card, I feel there's a pair of B66s in my future.

Thanks again Andrea!

Hi Andrea, that is wonderful of Brooks to make that offer. You've probably noticed that many of us here in the C & V forum love Brooks saddles .

Let me speak up on behalf of my fellow C&V folk, albeit with an opinion that is entirely my own.

Perhaps you should reconsider your offer of a 'couple of saddles at 50% off'.

Manufactured items generally have a net cost of 25% of their wholesale selling price returned to the manufacturer. In this case, a $100 retail saddle that commonly sells at retail for $75 would enter distribution with a wholesale price to the manufacturer of 80% of the retailers' acquisition cost from distribution. Long story short, the manufacturing cost on such on an item would be in the neighborhood of $12.00.

Give the guy a couple of saddles, free--even pay the postage. Why? Because he's the first. Be smart.

Hereafter--award ONE saddle to the monthly winner. And advertise and promote this offer.

Metric for your MBA types...
--Cost: less than a round of beer.
--Value: a multiple of thousands in terms of publicity, brand building and good will.

End flame.

Street cred:
--My first Brooks Saddle on my 1963 Rudge, lost now in time and space.
--My second Brooks Saddle bought new in 1978, a B66, now on my daily rider Sports-Tourer 1982 Schwinn Super Sport S/P, mounted with a seat sandwich.
--My third Brooks Saddle a new Brooks Flyer on my full blown tourer---1984 Miyata 610

Dear "mrmw"
I will certainly take your suggestion for the new website: "Picture of the Month" winner will get some special discount or prize.
Please join the forum "BROOKS Website" if you have more suggestions.
Thanks

Not true. It depends where the picture is 'jacked' from. Most of the big online picture hosting sites like flikr have wording in the user agreement you clicked that makes any picture you upload available for public use.

We've been through this though, A) Velospace has no such clause, and B) it wasn't jacked. Somebody (else) entered it into their photo competition.

If the person who entered it 'jacked it' from photobucket, flikr or a different photohosting site the copyright rules dont apply because you waved them when you clicked the user agreement.

It depends where the pictured was acquired from....interpret this anyway you want in regards to flikrs user agreement:

Yahoo! does not claim ownership of Content you submit or make available for inclusion on the Service. However, with respect to Content you submit or make available for inclusion on publicly accessible areas of the Service, you grant Yahoo! the following worldwide, royalty-free and non-exclusive license(s), as applicable:

With respect to photos, graphics, audio or video you submit or make available for inclusion on publicly accessible areas of the Service other than Yahoo! This license exists only for as long as you elect to continue to include such Content on the Service and will terminate at the time you remove or Yahoo! removes such Content from the Service.
As an example, I have pictures and images on my www.cyclespeugeot.com website that I took directly from www.peugeot.com Peugeot of France says on their website that content may be used for educational purposes only and not for commercial use. The moment i sell anything on my site i need to remove all content I pulled from their site.

From Photobucket:

However, by posting or making User Content available through the Site or via the Services, you hereby grant to Photobucket a nonexclusive, royalty-free, transferable, worldwide license to use, copy, modify, prepare derivative works from, distribute, publicly display and publicly perform (whether by means of a digital audio transmission or otherwise) and process your User Content, or any part of it, solely on and through the Site and Services, including without limitation (a) adapting the format of your User Content (for example by encoding or transcoding) for suitable display on the Site; and (b) displaying, in Photobucket's sole discretion, your public User Content in search results generated by the Photobucket search engine. In addition, where you have made your User Content public, posted a link to your User Content on another website or otherwise shared a link to your User Content, you grant to Photobucket a nonexclusive, royalty-free, worldwide right to sublicense the right to copy, modify, prepare derivative works from, and distribute your User Content as necessary to perform the Services, including without limitation the printing services offered by Partner Sites.
