Mixte frame question

I am talking to a local buyer about a mixte that I am selling. He is concerned that the drive side mid-stay is bent. I think it was made the way it is for chain clearance, if the tube was perfectly straight it would hit the chain for sure. Plus the driveside mid-stay tube is "scalloped" and not round because of the tight clearance. I have tons of pictures on my flickr account here, what is the C&V opinion?

I think I've seen this bend on a 70s Mercier mixte.

Middle stay on the drive side is intentionally arched/bowed for clearance on many mixte's. I've seen several that way.
