Ah yes, the new North American dream... get in an accident, get a lawyer and strike it rich.
My take is that you should:
1) File a claim with her insurance company. They should pay for a replacement bike of the same level (you should not have to be out any money to get an equivilant ride).
2) Keep the damaged bike on hand in case the insurance adjuster wants to see it (unlikely).
3) Be thankful that you didn't get injured.
4) Post a thread saying that not wearing a helmet saved your life (if you're like many other posters on this site anytime you walk away from a crash and were wearing a helmet, it's credited with saving your life).

And to the other poster who insinuated I was a scam artist, don't assume you know everything. Don't you think I should be given some sort of compensation for the trouble I've had to go through? If I had the choice of money versus getting the last 6 months of pain free time and my bike back, do you think I would take the money? NO! But I don't have that choice and the only compensation I can get is some money and the fact that my kids still have a father that still comes home every night.

thanks for all the information and advice. I feel ok today except for a bruised/swollen inner left thigh, bruised left forearm, and my right index finger aches like someone bent it back on me.
How long should I wait for symptoms to develop? I'm pretty sure I'm ok, but I'd hate to have something like a back or neck problem suddenly appear.
The bike was an '86 shogun lugged mountain bike, which cost me $175 on craigslist and $50 for fenders. It's not worth much, but the thing is a tank! They don't build bikes like that anymore.
I am glad to walk away from it and I'm going to invest in a really bright front light and new helmet.

In Canada, you have 2 years to close a claim and I'm assuming it's similar where you are, so don't rush it. Just make sure you are ok.

I wasnt' commenting on your accident. It sounds like you had some serious injuries & personally I think $20k isn't enough for the injuries you describe. I was commenting on the advice that the OP should get a lawyer after clearly stating in thier OP that they were not hurt.

How do you know that this person was either lazy or selfish? Is it simply because they were driving? I ride my bike 10k+ miles per year. I also drive sometimes. I suppose that makes me lazy & selfish.
Clearly, you have no idea what assault is. There are on-line dictionaries in which you can find the legal meaning of the word.

Since there were clearly no phyisical scars, I presume you're referring to mental scars? I agree that we should get bit bucks for unpleasent memories. Just think of the money I could be rolling in for things such as failing a school test, striking out at a big moment in a baseball game, being spanked as a punishment as a child, all the times schoolmates picked on me, the time my girlfriend broke up with me. Holy cow, now that I start thinking about all the unpleasent memories I should be paid for having to endure, I might be the richest man on the planet.
