While this doesn't excuse his hitting the pedestrian, I think it explains a lot. When Novak claimed that he 'never saw the guy' even though he rolled off the windshield, he might be telling the truth. Brain tumors can limit peripheral vision and reaction ability.....

If the ped is going to sue, he needs to file suit now - he might have more difficulty if it's just the estate. (besides - the victim is 86 years old himself).
