We had hoped to avoid getting an attorney, but now are considering one. I would not want to have anything like this accident on my record. In 45 years with the same insurance company (USAA) I have never caused an accident and my record with them is spotless. While USAA believes me, their claim still lays some doubt.
Also, USAA will not pay my deductible of $250.00. Additionally, USAA should not have to pay my wife's related medical bills. Also, I have about 40 hours of effort nto this whole thing.
If the other driver/insurance company is not going to accept responsibility, I think an attorney on contingency is in order, just to protect my interests.

USAA has always been great in the past, so they have fantastically loyal customers. However, when we in Florida were going through all the hurricane stuff a couple years ago, I was flabbergasted to discover USAA had made a list of '10 worst (or least responsive) insurance companies'. I think their corporate climate has changed in the last few years, and your experience with this is just one more data point leading to that suspicion.
EDIT: Over the years, I was rear-ended three times. I never had to pay the deductible (USAA). USAA should be going to bat for you; if they're not, I agree an attorney may be in order.

They simply called and said the other side was now saying it was my fault and took a recorded statement from me. They stated they believed me, and the photos of the damage supporeted my story (minor front end damage, heavy read end damage). My wife used to work for an attorney firm that specialized in auto and work comp. They always hated being up against USAA because they were so tough in going after the perpetrator.
However, at this point I want more than the deductible paid to me. This is nonsense, and I feel that the aggravation they are causing me is worth a bit, along with my wife's several days of hardly being able to breathe.
I was willing to forgive and forget up to now. But this bit about blaming it on me, when we were just sitting there stopped, and "crash" is a bit much. The insurance adjuter for the other party called for a statement. I left a message that, unless the other company was going to accept responsibility for the accident, I would not even talk to them.
No way am I going to give them a recorded statement, however.

Glad to hear that you are both Alright. I have never been in this kind of situation, so I have no advice to give, other than go after that girl, her insurance company and her parents for all your costs, including the court. Then add 33% for the lawyer and an additional 10% for all your grief. I will pray for your situation.
