The offense goes against your driver's license, or not, according to state law which according to reports here varies. If it goes against your record it does not go against your record because of what you *might* do, it goes against your record for what you *have* done. You have a operated a vehicle on a public road in violation of the traffic regulations which apply to it. You can argue that this is too harsh a punishment and evidently some states have decided that it is, but you are only being convicted of an offense that you have actually committed.
