I really think threatening this woman with lawyers to the point where they pulled the thread was simply over the top, and will get this guy far more negative response than either ignoring it or coming here and engaging on the forum. And deservedly so. F his lawyers, what is he the friggin KGB?

No not the KGB. The KGB was smart. Like you say, this outfit SBR and their directors, will get far more negative publicity thanks to their hard line tactics then they would have stood to lose monetarily -- had they made it right with the OP (of the censured thread). |

SBR was so good to me a year or two ago. I got 2007 Cervelo P2C on STEEP discount. I called them about buying their floor model...I was quoted a price, like $2100 or something. A few days go by...no bike...no charges on my credit card. I'm like WTF. I call them...guy I spoke with said they sold the floor model to someone else. I'm like WTF. Give the name of the dude that sold me the bike over the phone. Next day, I get a call back...they apologize...and send me a brand new, in-box P2C Dura-Ace build for $1800. That's right...$1800... I think the MSRP of that thing is like $3000+ Your mileage may vary.... |

I doubt the guy has any real lawyers. Maybe his brother-in-law lent him a favor. Lets face it, SBR just won't be able to profit enough after the cost of rent, staff, etc. in NY to afford an attorney to win such a difficult case. If he were to truly file suit (which he won't be able to win because it is the truth not libel, check the auto-admit case going on), he'd have to pay filing fee's, attorney retainer, attorney hourly rate, cost for RPD and discovery. After all that he'd have the option to mediate/arbitrate/litigate. Litigating being the most expensive. If you assume the attorney is billing at $300 an hour, charges 1k for a day in court, and researches/prepares for the case for 30 hours. He'd be looking at an 11k legal bill at the least. How many cervelo P2C's and soloist's (profit per unit) does SBR have to sell to cover that fee?

The only thing I have a serious problem with is coercion. That sort of thing should not be tolerated. If they don't want to honor a discount, well, so be it. It's not the first time that sort of thing has happened. The reason why we KNOW about these sorts of things is that people talk about them and are not COERCED into keeping quiet. Otherwise, there are two sides to this story and neither side is 100% anything, right or wrong. |

The President of SBR may be a trust fund kid who may no need to worry about "affording" lawyers (His company maybe a hobby, not a money making enterprise; you'd be surprised how many stores are like that in Manhattan!). Which would explain the haphazard way in which they do business, screwing one wronged customer (allegedly) one day, over compensating another the next.... Plus, they did get BF to pull the thread. Or was that a chicken clucking in the background ? :D |
