It's 50/50 umd won't get banned again:

"A 2002 study survey showed that among...prisoners released in 1994...within 3 years...51.8% were back in prison." - Wikipedia

There is "evidence that... those serving the longest time...had a significantly lower re-arrest rate." - Bureau of Justice Statistics Special Report

The longer he is banned, the better the chance umd won't get banned again. By the time he's racing in the Masters division, it should be safe to let him back.

Yep, when they take the prisoner out on a pine box, it's unlikely he'll be re-arrested.
